This website is operated by Queens Muay Thai. Throughout the site, the terms “we”, “us” and “our” refer to Queens Muay Thai. Queens Muay Thai offers this website, including all information, tools, and services available from this site to you, the user or participant, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. The Site provides information and offers (the “Services”) about Queens Muay Thai so that prospective users and participants can make informed decisions about the services, training or workshops in the program.

You acknowledge and agree that the Services provided and made available through our website, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Queens Muay Thai. At its discretion, Queens Muay Thai may offer additional website Services and/or products, or update, modify, or revise any current content and Services, and this Terms of Services shall apply to any additional Services and/or products and any updated, modified, or revised Services otherwise stipulated.

Queens Muay Thai reserves the right to cancel and cease offering any of the aforementioned Services and/or products. You acknowledge, accept, and agree that Queens Muay Thai shall not be held liable for any such updates, modifications, revisions, suspensions, or discontinuance of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications, shall constitute your acceptance of such updates, changes, and/or modifications, and as such, frequent review of this Agreement and any applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, revised, or modified terms, you must stop using the provided Services forthwith.

Furthermore, the user understands, acknowledges, and agrees that the Services offered shall be provided “as is” and as such Queens Muay Thai shall not assume any responsibility or obligation for the timeliness, missed delivery, deletion, and/or any failure to store user content, communication, or personalization settings.

Our scheduling store is hosted by Acuity Scheduling and our e-commerce store is hosted by Stripe, which allows us to sell our products and services to you. By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

Once you have purchased a membership or scheduled a class/seminar at Queens Muay Thai, you agree with the following scheduling policies:

• Queens Muay Thai reserves the right to cancel classes/sessions for statutory holidays, and/or extenuating circumstances. Students will be notified via e-mail newsletter prior to the start of any modified class/session or any schedule changes cancellations.

• Students with private training schedule changes are required to e-mail them to info@queensofbramptonmuaythai.com at least a week prior to the session. Make-up sessions are subject to availability and can only be scheduled within the week of the original session and do not carry into the weeks after. Missed sessions without e-mail notification before the start of the session will not be rescheduled for a make-up session.

Queens Muay Thai has a strict no-refund policy of processed payments for training and other purchases. All payments made through the website are final, non-refundable, non-exchangeable, and non-transferable. Queens Muay Thai is not responsible for a participant’s loss of training due to illness, injury, emergency situations or other unforeseen circumstances.

It is your responsibility to make use of the products or services that you have purchased. Failure to attend training programs or use services/products after your payment has been processed are not cause for refund.

If your purchase includes recurring payments, such as a monthly subscription, you have the option to pause/hold or cancel future payments of your subscription. All subscriptions are dated the same day as your initial purchase (e.g., First payment was made on May 15, next payments will be made on the 15th of every month). It is your responsibility to know your next payment date and contact Queens Muay Thai via email for your subscription hold or cancellation request no less than 7 days before the next payment in order for the subscription cancellation or hold to be processed on time. Monthly subscription pause/hold or cancellation requests made after a payment has been processed, will not be refunded (e.g., If your monthly payments are made every 15th of the month, you must request a cancellation at least 7 days before. If you request your pause/hold or cancellation on or after the 15th, your payment will not be refunded and only future monthly payments will not be processed).

Yearly memberships can be put on hold for a maximum of 2 months (e.g., Annual payment was made on May 15 and ends the following year May 14. Within that year, students can request up to 2 months maximum which can extend the yearly membership to finish July 14 the following year.) All hold requests must include a definitive start and end date. End dates can be extended or terminated early within the 2 month maximum timeframe. If you do not return to training after your hold ends and fail to contact us for an extension, your membership will automatically resume. No refunds will be issued.

You will receive an e-mail confirmation once your subscription has been paused or canceled.

This Student Code of Conduct is a guide for students on how to uphold the values of respect, discipline, and camaraderie during and outside of training. By following the Student Code of Conduct, you contribute to the supportive and empowering community at Brampton Muay Thai where everyone can learn, grow, and thrive.

All students and parents are required to review and agree with the following responsibilities as a member of our community.

If students severely violate the terms in the Student Code of Conduct, Brampton Muay Thai and its staff have the right to revoke your entry and/or terminate your membership without refund.

BE A GOOD STUDENT

• Greet classmates and instructors with the wai/Muay Thai bow to honor the art and the school.

• Treat instructors and classmates with respect and courtesy, regardless of age, gender, culture or skill level.

• Avoid negative behaviors that create conflict which can range from verbal (e.g. insults, gossip) , physical (e.g. pushing, spitting, fighting, unchecked intensity during drills) or sexual (e.g. inappropriate comments/touching, leering, voyeurism).

• Inform your instructors and training partners of any injuries, illnesses, or physical limitations before starting drills.

• Follow instructions and train to the best of your ability. If at any point in class you are unable to train, or need to take a break, you can do so and you will inform the staff and your training partners.

• Prioritize safety by practicing techniques with control and awareness of yourself and your training partners to prevent injury on yourself or others.

• When training with a partner, focus on the technique/drill, not socializing. Save it for outside of class time.

• If you see anything that may compromise anyone’s safety, you will get out of harm’s way and inform the staff.

• Train sober. If you are under the influence of alcohol or drugs, you will not be permitted entry.

• If you need to leave class early, you will inform the staff before the start of class so they can make arrangements for your training partners when you leave.

• Let your instructor know if you feel uncomfortable, unsafe, or unsure about anything. Address concerns with instructors or staff, to avoid gossip or unnecessary conflict.

• Ask questions and seek help whenever needed.

• Conduct yourself with sportsmanship and professionalism during competitions, seminars, and events.

• Uphold the values of respect, discipline, and humility both inside and outside training.

• Pay your tuition and cancel your membership prior to the next autopay date if necessary or notify staff via e-mail of any changes at least 7 days before your next billing date for membership holds or cancellations to avoid unwanted charges as there are no refunds.

RESPECT GYM FACILITIES

• Keep the facilities clean (e.g., throw garbage in bins). If an area needs attention, you will make a staff member aware.

• Do not step on the mats with shoes or bring food or drinks without lids into the training area. If you spill anything, clean it up.

• Clean and return borrowed equipment back where it belongs.

• Bring all your equipment home after class. If you leave any items behind, you will notify staff via email and arrange to have them picked up within a week. Any items left behind for longer than a week without notification will be donated or thrown out.

• Absolutely no illicit (e.g. drug sale/use) or inappropriate activities (e.g. sexual intimacy) within the facility.

COME TO CLASS PREPARED AND CLEAN

• Do not train with any symptoms of sickness. If any form of transferrable illness is suspected, you agree that the staff have the right to ask you to refrain from training until you provide a doctor's clearance certificate or once you are symptom-free.

• Wear appropriate attire for training (e.g., shirt, compression shorts/leggings underneath Muay Thai shorts, remove jewelry and accessories) and avoid inappropriate attire (e.g., shirtless, clothing with political or vulgar content, no compression shorts or leggings under shorts). You will be asked to change or sit out if you do not have appropriate clothing on for class.

• Practice proper hygiene coming into and during training (e.g., shower beforehand, wear deodorant, wear clean clothes and handwraps, trim fingernails and toenails short, dry off sweat with towel, cover bleeding cuts and clean up training area if necessary).

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or services may be available exclusively online through the website.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Certain content, products and services available via our Service may include materials from third-parties. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

If, at our request, you send certain specific submissions or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. Your submission of personal information through the store is governed by our Privacy Policy.

Queens Muay Thai shall reserve the right at any time it may deem fit, to modify, alter, and or discontinue, whether temporarily or permanently, our service, or any part thereof, with or without notice. In addition, we shall not be held liable to you or any third party for any such alteration, modification, suspension, and/or discontinuance of our Services, or any part thereof.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Queens Muay Thai, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Queens Muay Thai and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

You acknowledge and agree that Queens Muay Thai and any essential software that may be used in connection with our Services (“Software”) shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. Furthermore, you herein acknowledge and agree that any Content which may be contained in any advertisements or information presented by and through our Services or by advertisers is protected by copyrights, trademarks, patents, or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by Queens Muay Thai or such applicable licensor, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or create any plagiaristic works which are based on Queens Muay Thai Services (e.g., Content or Software), in whole or in part.

The School herein has granted you personal, non-transferable and non-exclusive rights and or license to make use of the object code of our Software on a single computer, as long as you do not, and shall not, allow any third party to duplicate, alter, modify, create, or plagiarize work from, reverse engineer, reverse assemble, or otherwise make an attempt to locate or discern any source code, sell, assign, sublicense, grant a security interest in and/or otherwise transfer any such right in the Software.

Furthermore, you do herein agree not to alter or change the Software in any manner, nature, or form, and as such, not to use any modified versions of the Software, including and without limitation, to obtain unauthorized access to our Services. You agree not to access or attempt to access our services through any means other than through the interface which is provided by Queens Muay Thai for use in accessing our Services.

You herein acknowledge, understand, and agree that the Queens Muay Thai trademarks, copyright, trade name, service marks, and other logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of Queens Muay Thai. You herein agree not to display and/or use in any manner the Queens Muay Thai logo or marks without Queens Muay Thai’s prior written consent.

Queens Muay Thai will always respect the intellectual property of others, and we ask that all of our users do the same. With regards to appropriate circumstances and at its sole discretion, Queens Muay Thai may disable and/or terminate the accounts of any user who violates our TOS and/or infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide us the following information:

• the electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest;


• a description of the copyrighted work or other intellectual property that you believe has been infringed upon;


• a description of the location of the site which you allege has been infringing upon your work;

A breach or violation of any of the Terms will result in an immediate termination of your Services.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of the Terms of Service shall not be construed against the drafting party.

Suppose any provision of these Terms of Service is determined to be unlawful, void or unenforceable. These Terms of Service and any separate agreements provided shall be governed by and construed following the laws of Ontario, Canada.
